Image Use & Reproduction

Last updated: September 2026

The Upchurch Collection of Magic uses images to document artifacts, illustrate the history of magic, and support educational and research content. Images appearing on this website may come from the Collection's own holdings, public-domain sources, Creative Commons–licensed materials, institutional archives, or other sources used with appropriate permission or attribution.

Rights and reuse conditions vary from image to image. Visitors should not assume that every image appearing on magic.museum is free to reproduce.

Public Domain Images

Many historical images used on this site—including vintage magic posters, photographs, advertisements, programs, and archival documents—may be in the public domain.

When an underlying work is in the public domain, copyright in the original work has generally expired or otherwise does not apply. However, the source from which a digital image was obtained may provide its own terms of use, attribution requests, access conditions, or reproduction guidance.

Where possible, magic.museum identifies the source of historical images so researchers and publishers can consult the originating institution before reuse.

Public-domain material displayed on this site may include material obtained from institutions such as the Library of Congress, the Smithsonian Institution, university collections, libraries, museums, and other archives.

Creative Commons–Licensed Images

Some images may be used under Creative Commons licenses.

Creative Commons licenses differ. Depending on the individual license, reuse may require attribution or may include limitations involving commercial use, modification, or redistribution.

Where a Creative Commons image is used, the applicable license and source should be identified in the image credit or attribution.

Anyone wishing to reuse such an image is responsible for complying with the terms of the applicable Creative Commons license.

Images from the Collection

Photographs of artifacts owned by The Upchurch Collection of Magic may be created specifically for the Collection and may be protected by copyright even when the historical object depicted is itself in the public domain.

Unless an image is specifically identified as public domain or licensed for reuse, photographs credited to The Upchurch Collection of Magic should not be reproduced, republished, distributed, or used commercially without permission.

Requests for publication, research, exhibition, educational, or media use are welcome.

Third-Party Images

Some images may be provided by magicians, donors, estates, collectors, photographers, organizations, auction houses, archives, or other third parties.

Rights in these images remain with their respective rights holders unless otherwise stated.

The appearance of a third-party image on magic.museum does not automatically grant permission for its reuse elsewhere.

The Collection makes reasonable efforts to identify image sources, creators, rights holders, and licensing information where known and applicable.

An image credit may include:

  • Photographer or creator
  • Holding institution or collection
  • Source
  • Rights holder
  • Copyright status
  • Creative Commons license
  • Donor or contributor

Attribution provided by magic.museum should not be removed when an image is reused under terms that require attribution.

If you believe an image has been incorrectly credited, misidentified, or used without appropriate authorization, please contact the Collection so the matter can be reviewed.

What Visitors May Do

Visitors may generally:

  • View and share links to pages on magic.museum
  • Use the website for personal research and educational reference
  • Reuse material that is clearly identified as public domain, subject to any applicable source or institutional guidance
  • Reuse Creative Commons–licensed images in accordance with the applicable license
  • Quote reasonable excerpts from original Collection text with appropriate attribution

What Visitors Should Not Do

Unless permission or an applicable license allows otherwise, visitors should not:

  • Reproduce Collection-owned photographs without permission
  • Remove or alter required attribution or rights information
  • Use Creative Commons material outside the terms of its license
  • Reproduce substantial portions of original magic.museum text or research without permission
  • Present Collection material in a way that falsely suggests sponsorship, affiliation, endorsement, or approval
  • Use third-party images simply because they appear on this website

Magician and Performer Photographs

Photographs of magicians, performers, authors, historians, and other individuals may come from a variety of lawful sources, including public-domain archives, Creative Commons collections, institutional repositories, the Collection's holdings, contributors, and other properly attributed sources.

The inclusion of a person on magic.museum is for historical, documentary, educational, or collection-related purposes.

Unless expressly stated otherwise, the appearance of a living performer or other individual on this website does not imply that the person sponsors, endorses, or is affiliated with The Upchurch Collection of Magic.

High-Resolution Images and Reproduction Requests

Higher-resolution images may be available for certain artifacts or Collection-owned photographs.

Researchers, publishers, journalists, filmmakers, museums, educators, and exhibition organizers may contact the Collection regarding:

  • Publication use
  • Exhibition use
  • Research requests
  • Educational reproduction
  • Media requests
  • Higher-resolution files
  • Image licensing or permissions

Availability depends on the image, its rights status, and the Collection's ability to authorize its use.

Corrections and Rights Concerns

The Upchurch Collection of Magic is a developing historical collection, and image attribution and rights information may be updated as additional research becomes available.

If you are a photographer, artist, rights holder, institution, estate representative, or other interested party and believe that an image has been incorrectly attributed or that its use should be reviewed, please contact us.

We welcome documented corrections and will review legitimate rights and attribution concerns.
